Letter stating that Captain [Joseph N.] Brown, Company B, 58th Regiment, Ohio Volunteer Infantry had committed several acts unbecoming a gentleman and an officer and he left him the choice either to resign or be brought before a court martial, that Brown preferred the first step, that John Ander Egg, late 1st Lieutenant in Garibaldi's army, enlisted in the 58th Regiment, Ohio Volunteer Infantry on February 10, 1862, that Company B being without a Captain on the day of the battle of Fort Donelson, Ander Egg volunteered to take charge of the company as skirmishers, that Ander Egg displayed so much military knowledge and personal bravery on that occasion that the officers of the 58th Regiment, Ohio Volunteer Infantry drew up a petition to have him appointed Captain in the regiment, and that according to these antecedents, he had appointed John Ander Egg as Captain in place of J[oseph N.] Brown, resigned, whose commission he enclosed. Bears a note stating that a Captain had been appointed at Washington City for the 58th Regiment, Ohio Volunteer Infantry and ordered to follow the regiment.

Krause of Company G, that in Krause's place, with the consent of the Governor of Ohio, he had appointed Sergeant Major Theodore Scheid, the senior non-commissioned officer of the 58th Regiment, Ohio Volunteer Infantry, and that he hoped Buckingham would have the kindness to provide Scheid's commission.

Letter stating that he was recommended some time since by Colonel F[rederick] Poschner and Lieutenant Colonel L[yman] S. Elliott for promotion to 1st Lieutenant in the 47th Regiment, Ohio Volunteer Infantry, that he did not aspire to a 1st Lieutenancy when there were so many 2nd Lieutenants worthy of promotion, that he was very much surprised when he found that he had been so recommended, that the promotion of a Sergeant or Sergeant Major over a 2nd Lieutenant would only engender bad blood and give him an unpleasant position in the regiment, that he therefore requested that 2nd Lieutenant J[oseph] L. Pinkerton of Company A or some other 2nd Lieutenant be promoted and that he be given a commission to fill their place, that he was formerly Orderly Sergeant of Company A and was promoted to the office of Sergeant Major by Colonel Poschner in October 1861, a position he had since held, and that if necessary, he could procure other recommendations as to his ability besides those now in Buckingham's hands.

Letter stating that he had written on February 17, informing Buckingham that on reporting himself per orders to Colonel [Frederick] Poschner on February 15, Poschner told him there were no vacancies in the 47th Regiment, Ohio Volunteer Infantry, that he had asked Buckingham what to do, but had as yet received no answer, that Poschner said he had not been informed of his appointment until his arrival, that although his commission was dated January 9, a Lieutenant Campbell, who was appointed by Governor David Tod, had arrived since he came and been assigned to a company, that as he had gone to considerable expense in equipping himself, he did not like to be thrown out in this manner and receive nothing for it, and that he referred Buckingham to his friend, Ed P. Christie, for all information regarding this affair and himself.

Patrick was appointed Colonel; stating that he thought his present position as Major entitled him to the regular line of promotion in the field officers; referring Buckingham to the several recommendations from those who knew him; and stating that when he was at Buckingham's office the previous week, he did not know the vacancy existed, and that he learned of the vacancy on his return to headquarters. Letter stating that he was returning the certificate of oath to his commission in the 24th Regiment, Ohio Volunteer Infantry and in so doing desired to call Buckingham's attention to a fact in connection therewith, that the commission was dated December 18, 1861, that the commission was received by him on January 1, 1862 at Somerset, Kentucky, that he was then acting as Lieutenant Colonel of the 31st Regiment, Ohio Volunteer Infantry and, being a sworn officer of that regiment, he was in doubt what to do in the premises and referred the matter to General [Albin F.] Schoepf who was commanding the brigade, that Schoepf referred the matter to General [George H.] Thomas commanding the division, that the result was that he was ordered to remain where he was as an officer of the 31st Regiment, Ohio Volunteer Infantry until a decision was obtained from General [Don Carlos] Buell, that he received said decision on or about February 18 or 20, and immediately started to join the 24th Regiment, Ohio Volunteer Infantry as ordered, that it was a requirement for the commission to be sworn to within ten days of its receipt, and that since he desired to avoid any vexation or trouble in the future, he was requesting that a new commission be issued to him "reciting" the appointment on December 18, 1861, in order to comply with the strict letter of the law within the limited time.

Letter recommending Joseph Dister for a Lieutenant's commission in the 58th Regiment, Ohio Volunteer Infantry; and stating that in the advance on the enemy's battery during their attack at Fort Donelson on February 14 and 15, 1862, Dister was ever attentive in aiding the regiment and particularly active in urging the troops to engage in their several duties, that Dister was in the three months' service and was well drilled, that Dister was a gentleman of good moral character, a brave man, and worthy of any position in the regiment, and that he highly recommended Dister for Tod's consideration should there be an opening anywhere.

Letter stating that he had spent seven months in the service of his country, that during this time he had, by constant study of Hardee's Tactics, been preparing himself to fill a higher position in the army than he now did, that he desired, if it could be had, a Lieutenant's commission, that he knew of none other he could ask for assistance except Martin who was associated with the Governor in his daily transactions, that Martin knew how a soldier was situated with regard to leaving his regiment, that he was unable to get what he desired without the assistance of a friend to represent him at Columbus, that it would be an accommodation for Martin to act in this capacity, that he would be under a thousand obligations to Martin, and that they anticipated a movement soon.

Letter stating that in case Lieutenant Colonel [John H.] Patrick was promoted to the Colonelcy of the 5th Regiment, Ohio Volunteer Infantry, he would recommend Major [Harry G.] Armstrong for promotion, that Armstrong's services on the late General [Frederick W.] Lander's staff had been very valuable and Lander entertained a great regard for him, and that he had little opportunity of forming a judgment about Armstrong as a field officer, but knew him to be a gentleman and brave soldier. Letter stating that on December 16, 1861, Surgeon Benjamin Tappan of the 8th Regiment, Ohio Volunteer Infantry went home on leave of absence for 60 days, having a broken arm, that on December 17, 1861, Thomas McEbright reported to him for duty bringing a commission from Governor William Dennison as Surgeon of the 8th Regiment, Ohio Volunteer Infantry and also bringing a letter from Dennison addressed to Lieutenant Colonel F[ranklin] Sawyer then commanding the regiment, that he consequently assigned Surgeon McEbright to duty, but had borne both McEbright and Tappan on the muster rolls as Surgeons of the regiment, that on February 15, Tappan reported to him for duty, his leave of absence having expired, and that he assigned Tappan to duty and now had two Surgeons and one Assistant Surgeon serving with the regiment; requesting directions as to how the question of which was Surgeon of the regiment might be established; and stating that he submitted the matter with the letter from Governor Dennison to division headquarters and if it was not established there, it would be sent to the War Department in Washington, that he took no cognizance of the letter as far as the removal of Surgeon Tappan was concerned as Tappan was regularly mustered into the U.S. service, that if the United States did not pay Surgeon McEbright for his services, the State of Ohio was in duty bound to pay him, and that if Tod could procure a transfer for one of these Surgeons, he would respectfully ask for reasons best known to himself and in conformity to the wishes of the regiment, that Surgeon Tappan be transferred and Surgeon McEbright be retained.
